Agency Agreement

The undersigned member (“Member”) nominates the SWRT Property Group (“Group”) as an agent for the purpose of proposing and negotiating bids to various energy entities for the leasing of property to recover natural gas and/or oil.

Each “Member” acknowledges that the “Group” and the Executive Committee are volunteers who are not compensated, and will hold them harmless from any and all actions and liabilities from any activities or statements as a result of the voluntary representation of the “Group”.  Each “Member” waives the right to pursue actions against the “Group” or its members.

Each “Member” understands that the Executive Committee and the membership at large are not experts in the legal or financial realms of gas/oil leasing, and will instead rely on their own counselors for expert advice.

Each “Member” agrees not to enter into a separate agreement with any company or group, pending the outcome of the bidding process as it pertains to the SWRT Property Group.

The “Group” sponsors a  “Community Charitable Outreach Program” to benefit Ross Twp.  The recommended voluntary donation is one percent (1%) of all funds received from the leasing of property and subsequent royalties.  The “Group”  will determine how these funds will be allocated. 

A voluntary contribution of Twenty-Five Dollars ($25.00) is requested.  Please include the payment (cash or check payable to cash) with this application.  Expenditures will be approved by a majority vote of the Executive Committee, and reported at the next general meeting.

I understand that the signing of this form does not obligate me to sign the lease negotiated by the “Group”.  I/we agree, that if I/we decide not to sign the lease negotiated by the “Group”, we will not use the form of the lease, nor sign with the same entity as the “Group” for a period of 6 months from the date the “Group” accepts a lease proposal.
